Welcome to Matchd ("Matchd," "we," "us," or "our"). By accessing or using matchdhomes.com (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Platform.

These Terms apply to all visitors, users, listing submitters, and anyone else who accesses or uses the Platform.

Matchd is a real estate discovery and matching platform designed to help buyers, renters, agents, brokers, and property owners connect with listings that match their preferences. The Platform allows users to:

• Search for and browse residential properties for rent or sale
• Submit preferences to receive a personalized match score for available listings
• View live listing data sourced from third-party providers and user submissions
• Submit property listings and subleases for discovery by other users

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You must be at least 18 years old to use the Platform.

Matchd is a technology platform and discovery service — not a licensed real estate brokerage, mortgage lender, property management company, or legal or financial advisor. Unless explicitly stated otherwise, Matchd does not:

• Represent buyers, sellers, landlords, or tenants in any real estate transaction
• Negotiate or facilitate lease agreements or purchase contracts
• Collect rent, security deposits, or any payments related to real estate transactions
• Verify the licensure, credentials, or identity of agents or brokers on the Platform

Any real estate transaction you enter into as a result of using the Platform is solely between you and the relevant parties. We strongly encourage you to work with a licensed real estate professional for any transaction.

Matchd does not guarantee the accuracy, completeness, timeliness, or reliability of any listing information displayed on the Platform. Listing details — including but not limited to price, availability, square footage, number of bedrooms and bathrooms, property features, and photos — may be outdated, incorrect, or incomplete.

There is no guarantee that any property listed on the Platform is available for rent or sale, or that the listed price reflects the actual asking price at the time of your inquiry. You should always verify current availability, pricing, and property details directly with the listing agent, broker, property manager, or owner before making any decisions.

Some listing data displayed on the Platform is sourced from third-party providers, including but not limited to:

• Licensed real estate agents and brokers who submit listings directly
• Property owners and managers who submit listings directly
• Third-party real estate data APIs and data partners
• Other users of the Platform

Matchd does not independently verify third-party listing data and is not responsible for errors, omissions, or inaccuracies in data sourced from third parties. The inclusion of any listing on the Platform does not constitute an endorsement, recommendation, or verification of that listing, property, or the party who submitted it.

By submitting a listing, sublease, or any other content to the Platform, you represent and warrant that:

• You are the listing agent, broker, property manager, owner, or current tenant with full authorization to submit the information
• All content you submit — including text, images, and other media — is either owned by you or you have the legal right to share it on third-party platforms
• Your submission does not violate any applicable laws, regulations, or third-party rights
• You have not copied content from MLS databases, Zillow, Realtor.com, or other third-party platforms without proper authorization

By submitting content, you grant Matchd a non-exclusive, royalty-free, worldwide license to display, reproduce, and distribute that content on the Platform for the purpose of connecting users with listings. Matchd reserves the right to remove any submission at its sole discretion.

You agree not to use the Platform to:

• Post fraudulent, misleading, or inaccurate listing information
• Scrape, crawl, or systematically extract data from the Platform without our written permission
• Circumvent, disable, or otherwise interfere with security features of the Platform
• Upload or transmit viruses, malware, or any other harmful code
• Use the Platform in any way that violates applicable local, state, national, or international laws
• Harass, threaten, or harm any user, agent, or third party through the Platform
• Post content that infringes on any third party's intellectual property or privacy rights
• Use automated tools to submit fake listings, generate spam, or manipulate match results

Violation of these prohibitions may result in termination of your access to the Platform and, where appropriate, referral to law enforcement.

All content, features, and functionality of the Platform — including but not limited to the Matchd name, logo, design, text, graphics, and code — are owned by Matchd and protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any Platform content without our prior written consent.

Third-party trademarks, service marks, and logos referenced on the Platform belong to their respective owners. Their inclusion does not imply any affiliation with or endorsement by Matchd.

To the fullest extent permitted by applicable law, Matchd and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of — or inability to use — the Platform or any listing information found on it.

This includes, but is not limited to, damages for loss of profits, goodwill, data, or other intangible losses resulting from:

• Inaccurate or outdated listing information
• Unavailability of a listed property
• Conduct of any agent, broker, landlord, or user you contact through the Platform
• Unauthorized access to or alteration of your data
• Any other matter relating to the Platform

Matchd's total liability to you for any claim arising out of these Terms or your use of the Platform shall not exceed $100 USD.

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Matchd does not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last updated" date at the top of this page. We may also notify you of material changes via email or a notice on the Platform. Your continued use of the Platform after any changes take effect constitutes your acceptance of the revised Terms.

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Miami-Dade County, Florida.
